Terms of Service

1. Introduction

These Terms of Service govern your access to and use of the Cashbus website, mobile applications, platform, products, services, software, content, and related functionality (collectively, the Services). The Services are operated by Scalinglocals OÜ, Harju maakond, Tallinn, Kristiine linnaosa, Liimi tn 1, 10621, Estonia. Registry Code: 14862219. By creating an account, accessing, or using any Cashbus Services, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree with these Terms, you must not access or use the Services.

2. Nature of the Services

Cashbus is a technology platform that facilitates access to digital asset services, payment services, account services, card services, and related financial technology solutions. Certain services available through Cashbus may be provided by independent regulated financial institutions, payment institutions, electronic money institutions, banking partners, card issuers, digital asset providers, or other third-party service providers. Cashbus does not guarantee the availability of any particular service, account, payment card, banking feature, digital asset functionality, or financial product.

3. Eligibility

To use the Services, you must be at least eighteen (18) years of age, have legal capacity to enter into binding agreements, not be located in a jurisdiction where the Services are prohibited, not be subject to sanctions, restrictions, embargoes, or legal prohibitions, and not use the Services for unlawful purposes. If you register on behalf of a legal entity, you represent and warrant that the entity is legally established, you are authorized to bind the entity, and the entity and its beneficial owners comply with all applicable laws.

4. Restricted Jurisdictions

Cashbus reserves the right to restrict, suspend, limit, or terminate access to Services in any jurisdiction where applicable laws prohibit the Services, regulatory uncertainty exists, sanctions apply, elevated compliance or financial crime risks exist, or Cashbus determines that offering Services may expose the Company to legal, regulatory, financial, reputational, or operational risk. Eligibility may change without prior notice.

5. Account Registration

You may be required to create an account before accessing certain Services. You agree to provide complete, accurate, and current information. You are solely responsible for maintaining accurate account information. Cashbus may refuse, suspend, restrict, or terminate any account application at its sole discretion. No person is entitled to an account merely by submitting an application.

6. Identity Verification

Cashbus may require identity verification before providing Services. Verification requirements may include government-issued identification, proof of address, selfie verification, video verification, source of funds documentation, source of wealth documentation, and additional compliance documentation. Failure to provide requested information may result in restrictions, delays, suspension, or termination of Services.

7. Account Security

You are solely responsible for account credentials, passwords, devices, authentication methods, and security settings. You must immediately notify Cashbus of any suspected unauthorized access. Cashbus is not liable for losses arising from credential compromise, user negligence, unauthorized access, device compromise, phishing attacks, malware, or social engineering attacks. You remain responsible for all actions conducted through your account unless prohibited by applicable law.

8. Digital Asset Services

Digital assets involve significant risks. Prices may fluctuate significantly. Markets may become illiquid. Digital assets may lose all value. Transactions may be irreversible. Blockchain networks may fail. Smart contracts may contain vulnerabilities. Regulatory treatment may change. Cashbus does not provide investment advice, tax advice, legal advice, accounting advice, or financial advice. All decisions are made solely by you.

9. Payment Cards and Account Services

Where available, users may access payment cards, account services, IBAN accounts, virtual accounts, or related financial services. Such services may be subject to additional agreements, regulatory requirements, issuer requirements, verification requirements, and geographic limitations. Cashbus does not guarantee approval, issuance, continuation, or renewal of any payment card or financial account.

10. User Obligations

You agree to comply with all applicable laws, provide accurate information, maintain account security, cooperate with compliance requests, and use Services only for lawful purposes. You must not engage in fraud, facilitate money laundering or terrorist financing, engage in sanctions evasion, use stolen funds, submit false information, attempt unauthorized access, abuse the Services, violate intellectual property rights, or interfere with platform operations.

11. Anti-Money Laundering and Compliance

Cashbus maintains a risk-based compliance program. We may conduct identity verification, transaction monitoring, blockchain analytics, fraud screening, sanctions screening, ongoing due diligence, source of funds reviews, and source of wealth reviews. Cashbus may delay transactions, refuse transactions, freeze funds where legally permitted, restrict accounts, suspend Services, or terminate accounts. No compensation shall be owed where such actions are taken in good faith for compliance, legal, regulatory, or risk management purposes.

12. Transactions

You are solely responsible for verifying wallet addresses, payment details, recipient details, and transaction amounts. Transactions submitted through blockchain networks are generally irreversible. Cashbus is not responsible for losses caused by incorrect wallet addresses, user errors, blockchain failures, third-party service failures, network congestion, or smart contract vulnerabilities.

13. Fees

Certain Services may involve fees. Applicable fees may be displayed within the platform, during transactions, within fee schedules, or within specific product agreements. Cashbus may modify fees at any time. Updated fees become effective upon publication unless otherwise stated.

14. Intellectual Property

All intellectual property rights relating to Cashbus and the Services remain the exclusive property of Cashbus or its licensors. Users receive a limited, revocable, non-exclusive, non-transferable license solely to access and use the Services in accordance with these Terms.

15. Suspension and Termination

Cashbus may suspend, restrict, or terminate Services immediately if required by law or regulators, if compliance concerns arise, if fraud is suspected, if false information is provided, if risk concerns arise, or if these Terms are violated. Cashbus may terminate Services at its sole discretion where legally permitted. Termination may occur without prior notice.

16. Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided on an 'as is' and 'as available' basis. Cashbus makes no representations or warranties regarding availability, reliability, accuracy, performance, fitness for purpose, merchantability, or non-infringement. Cashbus disclaims all warranties, whether express, implied, statutory, or otherwise.

17. Limitation of Liability

To the fullest extent permitted by law, Cashbus shall not be liable for indirect, consequential, incidental, special, or punitive damages, lost profits, lost revenue, lost business opportunities, loss of goodwill, loss of data, or loss resulting from digital asset value fluctuations. In no event shall Cashbus's aggregate liability exceed the total fees actually paid by the user to Cashbus during the twelve (12) months preceding the event giving rise to the claim.

18. Indemnification

You agree to indemnify, defend, and hold harmless Cashbus, its affiliates, officers, directors, employees, contractors, partners, licensors, and service providers from and against all claims, liabilities, damages, losses, penalties, judgments, costs, and expenses arising from your use of the Services, your violation of these Terms, your violation of applicable law, your violation of third-party rights, or fraudulent or unlawful conduct.

19. Governing Law and Disputes

These Terms shall be governed by and interpreted in accordance with the laws of Estonia. Any dispute arising from or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Estonia. Nothing in these Terms limits Cashbus's right to seek injunctive relief or protective remedies in any competent jurisdiction.

20. Amendments

Cashbus may modify these Terms at any time. Updated versions become effective upon publication unless otherwise stated. Continued use of the Services constitutes acceptance of the updated Terms.
